Apex Golf Lab LLC

Introduction
Apex Golf Lab LLC (“Apex Golf Lab,” “Apex,” “we,” “us,” or “our”) provides a members-focused indoor golf performance facility designed to offer golfers a premium, technology-driven environment for practice, play, instruction, club fitting, and player development.
By purchasing a membership, making a reservation, scheduling a service, entering the facility, bringing a guest, or otherwise using Apex Golf Lab’s website, facility, equipment, or services, you acknowledge that you have read, understood, and agree to these Terms of Use.
These Terms are intended to promote the safety, security, fairness, and enjoyment of everyone using Apex Golf Lab.
Apex Golf Lab reserves the right to update or modify these Terms of Use from time to time. Continued use of Apex Golf Lab following an update constitutes acceptance of the then-current Terms.
Membership
Apex Golf Lab memberships are issued to individual members and are subject to the benefits, included hours, rates, limitations, and other conditions associated with the membership selected at the time of enrollment.
Memberships are personal to the registered member and may not be transferred, shared, loaned, or used by another person unless expressly authorized by Apex Golf Lab.
Members are responsible for maintaining accurate contact and payment information.
Membership benefits, rates, operating hours, policies, and included services may be modified by Apex Golf Lab from time to time. Any material changes will be communicated to members as appropriate.
Apex Golf Lab reserves the right to establish reasonable membership limits or temporarily suspend enrollment to maintain facility availability and the quality of the member experience.
New Member Setup and Facility Orientation
All new members are required to complete the Apex Golf Lab onboarding process before receiving independent facility access.
A one-time $39 setup fee is required for all new memberships and is payable at the time of facility orientation.
New members must schedule and complete a facility orientation. During orientation, members may receive instruction regarding facility access, simulator operation, safety procedures, reservations, guest policies, and other facility rules.
Apex Golf Lab may withhold independent facility access until required onboarding steps have been completed.
Facility Access
Apex Golf Lab provides authorized members with access to the facility during designated member-access hours, currently 5:00 AM through 11:00 PM daily, subject to reservations, closures, maintenance, special events, emergencies, or other restrictions.
Facility access credentials are issued for the exclusive use of the individual member.
Members may not share access credentials, mobile access, keys, codes, or other means of entry with another person.
Members may not permit unauthorized individuals to enter the facility or allow another person to enter using the member’s credentials except for authorized guests accompanying that member in accordance with Apex Golf Lab’s guest policy.
Members are responsible for ensuring doors close and secure properly after entering or leaving the facility.
Because Apex Golf Lab may operate without staff physically present, members are expected to follow all posted instructions, safety requirements, emergency procedures, and facility rules.
Misuse of facility-access privileges may result in immediate suspension or termination of access or membership.
Reservations and Booking
Simulator use is subject to availability and must be reserved through Apex Golf Lab’s authorized booking system unless otherwise permitted by management.
Reservations provide access to the selected simulator bay for the specific period reserved.
Members are responsible for reviewing reservation details before completing a booking.
Sessions begin and end at the scheduled reservation times. Arriving late does not extend the reservation.
Members should complete play and leave the simulator bay ready for the next reservation before their scheduled time expires.
Additional time may be reserved or added when permitted by the member’s plan and when availability allows.
Members may not occupy a simulator bay beyond their reserved period when another reservation follows.
Apex Golf Lab reserves the right to establish booking windows, reservation limits, cancellation requirements, no-show policies, and other reasonable booking restrictions.
Included Membership Hours and Additional Time
Certain memberships may include a specified amount of simulator time during each membership period.
Included hours are subject to the terms of the applicable membership and generally must be used during the applicable membership period unless Apex Golf Lab expressly provides otherwise.
Unused included hours do not have cash value and may not be sold, transferred, or exchanged.
Once included hours have been used, additional simulator time may be available at the member rate associated with the applicable membership.
Membership benefits and discounted rates apply only to the member to whom the membership is issued unless otherwise stated.
Guest Policy
Members may bring guests in accordance with Apex Golf Lab’s guest policy.
A member may bring up to two guests, with a maximum of three players per simulator bay, including the member.
The member who made the reservation must be present with their guests for the duration of the reservation.
Guests do not receive independent facility-access privileges and may not remain in the facility without the sponsoring member.
Members are responsible for ensuring that their guests understand and follow Apex Golf Lab’s safety requirements, facility rules, equipment-use requirements, and these Terms of Use.
The sponsoring member may be held responsible for damage, misconduct, or policy violations caused by their guests.
Apex Golf Lab reserves the right to restrict or revoke guest privileges when necessary to protect facility safety, security, availability, or the member experience.
Simulator Profiles
Apex Golf Lab may provide members with an individual AGL Uneekor Profile for use with simulator technology.
Use of an AGL Uneekor Profile is optional and is not required to use Apex Golf Lab’s simulator bays.
Members who choose to use their profile may be able to maintain shot data, golf statistics, performance information, and other simulator-generated information over time.
Members are responsible for protecting their login credentials and should not allow others to use their individual profile.
Availability of profile features, stored data, statistics, or other technology-dependent functionality may be subject to the systems and services provided by third-party technology providers.
Lessons and Club Fittings
Apex Golf Lab may offer golf instruction, performance coaching, club fitting, and related services to members and non-members.
Lessons and fittings are subject to separate scheduling, pricing, cancellation, and service policies applicable at the time of booking.
Golf instruction and club fitting are intended to provide professional guidance and recommendations based on available technology, observations, measurements, and information provided by the participant.
Individual results cannot be guaranteed.
Facility Rules and Player Conduct
All members and guests are expected to behave responsibly and respectfully while using Apex Golf Lab.
Users must:
- Swing clubs only within designated hitting areas.
- Maintain a safe distance from anyone swinging a golf club.
- Ensure the hitting area is clear before every swing.
- Use simulator and facility equipment only for its intended purpose.
- Follow all posted safety instructions and facility rules.
- Respect other members, guests, neighboring businesses, and Apex property.
- Maintain the facility in a clean and orderly condition.
Reckless or unsafe behavior is prohibited.
This includes intentionally striking walls, ceilings, floors, screens, monitors, projectors, cameras, sensors, furniture, or other equipment; throwing clubs; horseplay; fighting; tampering with equipment; or engaging in conduct that creates an unreasonable risk of injury or property damage.
Apex Golf Lab reserves the right to suspend or terminate facility access or membership for unsafe, disruptive, abusive, threatening, fraudulent, or otherwise inappropriate conduct.
Equipment Use and Responsibility
Apex Golf Lab’s simulator bays contain specialized technology and equipment, including launch monitors, cameras, impact screens, projectors, computers, displays, hitting surfaces, and related equipment.
Equipment must not be moved, disconnected, modified, struck intentionally, or otherwise tampered with.
Members and guests may use their own golf clubs and other approved golf equipment.
All clubs and equipment should be inspected before use. Damaged clubs, loose clubheads, or equipment that could create a safety risk should not be used.
Apex Golf Lab reserves the right to prohibit equipment that could damage the simulator, impact screen, turf, facility, or other property.
Damage to Facility or Equipment
Members are responsible for using Apex Golf Lab’s facility and equipment appropriately.
A member may be financially responsible for damage caused by the member or the member’s guests when the damage results from misuse, negligence, intentional conduct, violation of facility rules, or unauthorized modification or handling of equipment.
This may include reasonable costs associated with inspection, repair, replacement, labor, service calls, or other expenses resulting from the damage.
Normal wear resulting from proper use of the facility and equipment is excluded.
Members should report damaged or malfunctioning equipment promptly and should not attempt repairs unless specifically authorized by Apex Golf Lab.
Food and Beverages
Food and non-alcoholic beverages may be permitted in designated areas of the facility.
Food and beverages must be kept away from simulator computers, launch monitors, projectors, electronic equipment, hitting areas, and other areas where spills could cause damage or create a safety hazard.
Members and guests are expected to clean up after themselves and properly dispose of trash.
Additional cleaning or repair charges may be assessed when excessive mess, spills, or damage result from a member or guest’s conduct.
Alcohol, Smoking and Controlled Substances
Outside alcohol is prohibited unless expressly permitted by Apex Golf Lab and allowed by applicable law.
Smoking, vaping, illegal drugs, and unlawful controlled substances are prohibited inside the facility.
No person may use a simulator, swing a golf club, or participate in activities while impaired to an extent that creates a safety risk.
Apex Golf Lab reserves the right to require any individual engaging in unsafe or inappropriate conduct to leave the facility.
Minors and Junior Golfers
Minors may use Apex Golf Lab only in accordance with applicable membership, reservation, lesson, guest, and supervision requirements.
A parent, legal guardian, or responsible adult is responsible for the supervision and conduct of minors under their care.
Children must not be permitted to enter active hitting areas, interfere with simulator equipment, or engage in conduct that creates a safety risk.
Parents and guardians are responsible for ensuring that minors comply with all facility and safety rules.
Personal Property
Members and guests are responsible for their personal belongings.
Apex Golf Lab is not responsible for lost, stolen, misplaced, or damaged golf clubs, bags, electronic devices, clothing, vehicles, or other personal property except to the extent liability cannot legally be excluded.
Items left behind may be retained temporarily or disposed of in accordance with Apex Golf Lab’s lost-property procedures.
Security Cameras and Facility Monitoring
For safety and security purposes, Apex Golf Lab utilizes video surveillance in and around portions of the facility.
Video may be used to investigate accidents, unauthorized access, theft, vandalism, equipment damage, violations of facility rules, or other security and operational matters.
Use and handling of personal information and surveillance information are further described in the Apex Golf Lab Privacy Policy.
Health, Safety and Assumption of Risk
Golf and golf-related activities involve inherent risks, including risks associated with swinging clubs, moving golf balls, equipment, physical exertion, slips, trips, falls, and the actions of other participants.
By entering Apex Golf Lab or participating in activities at the facility, members and guests acknowledge these inherent risks and voluntarily assume the risks ordinarily associated with participation in indoor golf activities, to the extent permitted by applicable law.
Each participant is responsible for determining whether they are physically capable of participating safely.
Individuals with medical or physical concerns should consult an appropriate healthcare professional before participating.
All users are responsible for following posted safety rules and exercising reasonable care for themselves and others.
Technology and Service Availability
Apex Golf Lab relies on technology provided by various third parties.
Simulator software, launch monitors, internet connectivity, booking systems, access-control systems, computers, projectors, and other services may occasionally become unavailable because of maintenance, updates, technical failures, power outages, internet interruptions, or circumstances outside Apex Golf Lab’s reasonable control.
Apex Golf Lab does not guarantee uninterrupted operation of every technology or service.
When a material facility or technology failure prevents use of a paid or reserved service, Apex Golf Lab may, at its discretion and subject to applicable law, provide replacement time, rescheduling, account credit, or another reasonable remedy.
Privacy and Personal Information
Apex Golf Lab collects and processes information necessary to administer memberships, reservations, facility access, payments, lessons, fittings, security, simulator profiles, and other services.
Apex Golf Lab does not sell personal information for monetary consideration.
Our collection, use, disclosure, retention, and protection of personal information are described more fully in the Apex Golf Lab Privacy Policy, which is incorporated into these Terms by reference.
Suspension and Termination
Apex Golf Lab reserves the right to suspend or terminate membership, facility access, reservation privileges, or guest privileges for violations of these Terms, facility rules, payment obligations, safety requirements, or other applicable policies.
Serious violations involving safety, unauthorized access, intentional property damage, theft, threats, violence, fraud, or illegal activity may result in immediate suspension or termination.
Termination or suspension does not eliminate outstanding payment obligations or responsibility for damage caused before termination.
Limitation of Liability
To the fullest extent permitted by applicable law, Apex Golf Lab LLC and its owners, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of the facility, services, equipment, technology, or website.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by applicable law, members and guests agree to be responsible for claims, damages, losses, or expenses resulting from their own negligent, reckless, intentional, unlawful, or unauthorized conduct or their violation of these Terms.
Members also agree to be responsible, to the extent permitted by law, for conduct of guests they bring into the facility.
Governing Law
These Terms of Use are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.
Any dispute relating to these Terms or use of Apex Golf Lab will be subject to the jurisdiction of courts of competent jurisdiction in Connecticut, except where applicable law requires otherwise.
Severability
If any provision of these Terms of Use is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Changes to These Terms
Apex Golf Lab may revise these Terms of Use periodically to reflect changes to our facility, memberships, services, technology, policies, or legal requirements.
The current version will be posted on our website with its effective date.
Final Agreement
By purchasing or maintaining a membership, making a reservation, entering Apex Golf Lab, bringing a guest, scheduling a service, or participating in any activity at the facility, you acknowledge that you have read, understood, and agree to these Terms of Use and applicable Apex Golf Lab policies.
Individuals who do not agree to these Terms should not purchase a membership, make a reservation, access the facility, or participate in Apex Golf Lab activities.
Apex Golf Lab is committed to providing a safe, professional, technology-driven environment where golfers can practice, play, learn, and improve. We appreciate every member and guest doing their part to maintain that environment.
