Membership Agreement & Facility Rules

Apex Golf Lab LLC
Effective Date: August 18, 2026

This Membership Agreement & Facility Rules document (“Agreement”) governs membership in and use of Apex Golf Lab LLC, located at 99 Main Street, Bristol, Connecticut 06010 (“Apex Golf Lab,” “Apex,” “we,” “our,” or “us”).

By purchasing, activating, or using an Apex Golf Lab membership, you acknowledge that you have read, understand, and agree to this Agreement, the Apex Golf Lab Terms of Use, applicable booking and cancellation policies, and posted facility rules.

Membership

Membership is personal to the named member and may not be sold, transferred, shared, loaned, or assigned without written authorization from Apex Golf Lab.

Membership benefits are limited to the membership plan purchased and are subject to availability and the rules applicable to that plan.

Apex Golf Lab may offer different membership levels with different included simulator hours, booking privileges, additional-time rates, and benefits. The membership terms displayed at enrollment form part of this Agreement.

New Member Setup & Facility Orientation

All new members must complete a facility orientation before receiving independent facility access.

A one-time $39 setup fee is required for all new memberships and is payable at the time of facility orientation.

During your orientation, we will review facility access, simulator operation, reservations, safety procedures, guest policies, and other important information needed to use Apex Golf Lab independently.

Facility access may be withheld until the required orientation and onboarding steps have been completed.

Membership Term, Billing & Renewal

Membership fees are billed according to the terms presented at enrollment.

For recurring memberships, the member authorizes Apex Golf Lab and its payment processor to charge the payment method on file for recurring membership fees, applicable taxes, and other authorized charges.

Members are responsible for maintaining a valid payment method.

Membership, reservation, or facility-access privileges may be suspended if payment cannot be successfully processed.

Automatic renewal and cancellation rights will be administered in accordance with the membership terms and applicable Connecticut and federal law.

Included Simulator Hours

Included simulator hours are allocated according to the member’s selected membership plan.

Unless a membership plan expressly states otherwise:

  • Unused monthly hours expire at the end of the applicable billing period.
  • Included hours do not roll over.
  • Included hours have no cash value.
  • Included hours may not be transferred to another person.

After included hours have been used, eligible members may reserve additional simulator time at the applicable member rate, subject to availability.

Reservations

All simulator time must be reserved through the designated Apex Golf Lab booking system.

Reservations are subject to availability, membership-specific booking windows, duration limits, and other applicable booking rules.

Members must begin and end within their reserved time.

Late arrival does not extend a reservation.

Additional time may be used only when availability permits and the additional time has been properly added through the booking system.

Cancellation & No-Show Policy

If you need to cancel or reschedule a reservation, please do so at least 24 hours before the scheduled reservation time.

Cancellations made within 24 hours of the scheduled reservation will result in the reserved time being deducted from the member’s included membership hours.

If the reservation was purchased separately, the booking fee will not be refunded or credited.

No-shows are treated as late cancellations and the reserved time will be deducted from the member’s available hours or charged as applicable.

Repeated late cancellations or no-shows may result in booking restrictions.

Guest Policy

Members may bring up to two guests during an eligible simulator reservation.

There is a maximum of three players per simulator bay, including the member.

The member who made the reservation must remain present for the entire reservation and is responsible for the conduct of their guests.

Guests must comply with all Apex Golf Lab rules and may be required to complete a liability waiver before participating.

Guest privileges may not be used to:

  • Resell simulator access.
  • Provide unauthorized paid instruction.
  • Operate a commercial activity.
  • Circumvent Apex Golf Lab membership requirements.

Apex Golf Lab reserves the right to restrict or revoke guest privileges in cases of misuse.

Facility Access

Authorized members may access Apex Golf Lab during published operating hours, currently 5:00 AM to 11:00 PM daily, subject to closures, maintenance, special events, emergencies, or other operational requirements.

Facility-access credentials are personal and may not be shared.

Members may not:

  • Provide their access credentials to another person.
  • Admit unauthorized individuals into the facility.
  • Prop open secured doors.
  • Circumvent facility access-control systems.

Members are responsible for ensuring that secured doors close properly after entering or leaving the facility.

Misuse of facility-access privileges may result in suspension or termination of membership.

Unstaffed Operation

Apex Golf Lab may operate without employees physically present during some or all operating hours.

Members understand that immediate on-site staff assistance may not always be available.

Members and guests are responsible for following all posted:

  • Safety procedures
  • Simulator instructions
  • Facility rules
  • Emergency procedures

In an emergency requiring police, fire, or medical assistance, call 911.

Junior Members & Minors

Junior memberships and use of the facility by minors are subject to age, supervision, access, waiver, and parent or guardian requirements established by Apex Golf Lab.

A parent or legal guardian must complete any required agreements and waivers for a minor.

Apex Golf Lab may restrict independent facility access for minors and may require a parent, guardian, or other authorized adult to remain present.

Facility Safety

Only the golfer actively hitting may enter the designated hitting area.

Other players and guests must remain safely behind or outside the hitting zone.

Practice swings may be taken only in areas where they can be performed safely.

The following are prohibited:

  • Horseplay
  • Reckless swinging
  • Throwing golf clubs
  • Intentionally striking balls outside designated hitting areas
  • Unsafe behavior that creates an unreasonable risk to people, equipment, or property

Members are responsible for making sure their guests understand and follow these safety requirements.

Simulator & Equipment Care

Members and guests must use launch monitors, cameras, computers, touchscreens, projectors, hitting mats, impact screens, furniture, and other Apex Golf Lab property only for their intended purposes and according to posted instructions.

Golf clubs and golf balls must be clean, undamaged, and suitable for indoor simulator use.

Apex Golf Lab may prohibit equipment that could damage simulator screens, hitting surfaces, technology, or other property.

Members and guests may not move, disconnect, modify, strike intentionally, or tamper with Apex Golf Lab equipment.

Damage to Facility or Equipment

A member may be financially responsible for damage caused by the member or their guests when the damage results from:

  • Intentional misconduct
  • Reckless conduct
  • Negligence
  • Misuse of equipment
  • Failure to follow posted instructions or facility rules

This may include reasonable costs associated with inspection, repair, replacement, labor, or required service.

Normal wear resulting from proper use is excluded.

Members should promptly report damaged or malfunctioning equipment and should not attempt repairs unless specifically authorized by Apex Golf Lab.

Member & Guest Conduct

Members and guests are expected to behave respectfully and responsibly.

The following conduct is prohibited:

  • Harassment
  • Threats
  • Violence
  • Theft
  • Vandalism
  • Intentional property damage
  • Illegal activity
  • Conduct that materially interferes with another member’s use or enjoyment of the facility

Smoking and vaping are prohibited inside Apex Golf Lab.

Illegal drugs and unlawful substances are prohibited.

No person may participate in golf activities while impaired to a degree that creates a safety risk.

Lessons, Club Fittings, Leagues & Events

Lessons, club fittings, leagues, tournaments, and events may have separate pricing, eligibility, booking, cancellation, and participation requirements.

Any terms specifically provided for those services or events will control with respect to the applicable service or event.

Assumption of Risk & Release

Participation in golf and golf-related activities involves inherent risks.

These risks may include, among other things:

  • Swinging golf clubs
  • Struck or deflected golf balls
  • Physical exertion
  • Simulator and golf equipment
  • Slips, trips, and falls
  • Actions of other participants

By entering the facility or participating in activities at Apex Golf Lab, members acknowledge and voluntarily assume the ordinary and inherent risks associated with those activities.

Members are responsible for determining whether they are physically capable of participating safely and for complying with all posted safety rules and instructions.

To the fullest extent permitted by applicable law, members release and hold harmless Apex Golf Lab LLC and its owners, employees, agents, and contractors from claims arising from the ordinary inherent risks associated with participation in golf-related activities or use of the facility, except to the extent such liability cannot legally be waived or limited.

Members acknowledge that Apex Golf Lab may operate without staff physically present and accept the additional responsibility of using the facility and equipment safely and following posted emergency procedures.

Security & Video Monitoring

For safety, security, property protection, and facility management, Apex Golf Lab may use security cameras, alarms, access-control systems, and related security technologies.

Common and public areas of the facility may be subject to video surveillance.

Members and guests should not expect privacy in monitored common areas.

Security recordings and access information may be reviewed in connection with:

  • Safety incidents
  • Unauthorized access
  • Suspected policy violations
  • Equipment or property damage
  • Theft or vandalism
  • Legal or law-enforcement requests

Personal Property

Members and guests are responsible for their personal belongings.

Apex Golf Lab is not responsible for lost, stolen, misplaced, or damaged golf clubs, golf bags, electronics, clothing, vehicles, or other personal property except to the extent liability cannot legally be excluded.

Membership Suspension or Termination

Apex Golf Lab may suspend or terminate membership, booking privileges, guest privileges, or facility access for material or repeated violations of:

  • This Agreement
  • Facility rules
  • Safety requirements
  • Payment obligations
  • Booking policies
  • Other applicable Apex Golf Lab agreements or policies

Serious misconduct involving safety, unauthorized access, intentional property damage, theft, violence, fraud, or illegal activity may result in immediate suspension or termination.

Financial consequences of cancellation, suspension, or termination will be governed by applicable membership terms, policies, and law.

Changes to This Agreement

Apex Golf Lab may revise this Membership Agreement & Facility Rules from time to time to reflect changes in memberships, operations, facility procedures, technology, safety requirements, or legal obligations.

The current version will be posted on the Apex Golf Lab website.

Material changes affecting existing contractual membership obligations will be handled in accordance with applicable law.

Member Acknowledgment

By purchasing, activating, or using an Apex Golf Lab membership, the member acknowledges that they have read and understand this Membership Agreement & Facility Rules, including the Assumption of Risk & Release provisions.

The member voluntarily agrees to these terms and accepts responsibility for ensuring that their guests comply with all applicable Apex Golf Lab rules and policies.

Members may be required to separately provide electronic acceptance or a signature during enrollment or onboarding.
