Liability Waiver, Release & Assumption of Risk

Participant Agreement

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

In consideration for being permitted to enter and use Apex Golf Lab LLC (“Apex Golf Lab”), including its indoor golf simulators, hitting bays, golf equipment, practice areas, lessons, club fittings, leagues, tournaments, events, and related activities (collectively, the “Activities”), you acknowledge and agree to the following.

Acknowledgment of Risks

Golf and indoor golf activities involve inherent and other risks.

These risks may include, but are not limited to:

  • Being struck by a golf club or golf ball
  • Contact with other participants or equipment
  • Slips, trips, and falls
  • Muscle strains or other injuries resulting from physical exertion
  • Equipment malfunction
  • Risks arising from the actions or inattention of other participants

You also acknowledge that Apex Golf Lab may operate without staff physically present during some or all operating hours and that immediate on-site assistance may not be available.

Assumption of Risk

By choosing to participate in Activities at Apex Golf Lab, you voluntarily and knowingly assume the ordinary and inherent risks associated with your participation.

You agree to exercise reasonable care, follow all posted rules and instructions, remain within designated areas, and stop participating if you believe conditions are unsafe.

You are responsible for ensuring that you participate in a safe and responsible manner.

Release of Liability

TO THE FULLEST EXTENT PERMITTED BY CONNECTICUT LAW, YOU RELEASE AND HOLD HARMLESS APEX GOLF LAB LLC AND ITS MEMBERS, OWNERS, MANAGERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AGENTS, LANDLORDS, AFFILIATES, AND SERVICE PROVIDERS (collectively, the “Released Parties”) from claims arising from the ordinary and inherent risks of your voluntary participation in the Activities.

This release is not intended to waive or release claims that cannot lawfully be waived under applicable law and shall be interpreted only to the maximum extent permitted by law.

Responsibility for Conduct & Property Damage

You are responsible for your conduct while at Apex Golf Lab.

If you are a member bringing guests into the facility, you agree to ensure that your guests follow all applicable facility and safety rules.

You may be held financially responsible for property or equipment damage caused by your:

  • Intentional misconduct
  • Reckless conduct
  • Negligence
  • Misuse of equipment
  • Failure to follow posted instructions or facility rules

Members may also be held responsible, to the extent permitted by law and applicable Apex Golf Lab policies, for damage caused by their guests.

Medical Condition & Emergency Assistance

By participating in Activities at Apex Golf Lab, you represent that you are physically able to participate or have made your own determination, with appropriate professional advice if needed, regarding your ability to participate.

If an emergency occurs, you authorize reasonable emergency assistance to be requested on your behalf when circumstances make such assistance appropriate.

You understand that Apex Golf Lab does not guarantee that employees, medical personnel, or other staff will be physically present at the facility.

In an emergency requiring police, fire, or medical assistance, call 911.

Unstaffed Facility

Apex Golf Lab may operate without employees physically present during some or all operating hours.

By using the facility during unstaffed periods, you acknowledge and accept the additional responsibility of:

  • Using the facility and equipment safely
  • Following simulator and equipment instructions
  • Following posted safety rules
  • Remaining aware of other participants
  • Following posted emergency procedures
  • Reporting equipment or facility problems when appropriate

Immediate on-site assistance may not be available.

Personal Property

You are responsible for your golf clubs, golf bag, electronics, clothing, vehicles, and other personal property brought to Apex Golf Lab.

Apex Golf Lab is not responsible for lost, stolen, misplaced, or damaged personal property except to the extent liability cannot legally be excluded.

Security Cameras & Facility Monitoring

Common and public areas of Apex Golf Lab may be monitored by security cameras and access-control systems for safety, security, property protection, and operational purposes.

Security recordings and access information may be reviewed in connection with safety incidents, unauthorized access, suspected violations of facility rules, property or equipment damage, theft, vandalism, or other legitimate security and operational purposes.

Compliance With Apex Golf Lab Rules

You agree to comply with applicable:

  • Apex Golf Lab Terms of Use
  • Membership Agreement & Facility Rules
  • Booking and cancellation policies
  • Posted safety requirements
  • Facility rules
  • Reasonable instructions regarding use of the facility and equipment

Unsafe, reckless, abusive, destructive, or otherwise prohibited conduct may result in removal from the facility and suspension or termination of membership, reservation, guest, or facility-access privileges.

Minor Participants

If a participant is under 18 years of age, a parent or legal guardian must complete or electronically accept any required agreement or waiver on behalf of the minor.

The parent or legal guardian represents that they have authority to provide such consent and agrees to ensure that the minor complies with Apex Golf Lab’s facility and safety rules.

Any release or waiver involving a minor is intended to apply only to the extent permitted and enforceable under Connecticut law.

Apex Golf Lab may establish additional supervision and facility-access requirements for junior golfers and minors.

Governing Law & Severability

This Liability Waiver, Release & Assumption of Risk is governed by the laws of the State of Connecticut.

If any provision is determined to be invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.

Acknowledgment & Voluntary Agreement

BY ACCEPTING THIS LIABILITY WAIVER, RELEASE & ASSUMPTION OF RISK, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ITS TERMS, UNDERSTAND THAT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS TO THE EXTENT PERMITTED BY LAW, AND ACCEPT IT VOLUNTARILY.

Electronic acceptance of this waiver may have the same effect as a physical signature to the extent permitted by applicable law.

For a participant under 18, acceptance must be provided by a parent or legal guardian when required.
